The auction will be conducted at our Seattle area auction facility, 18226 68th Avenue NE, Kenmore, WA. Other items at the auction include contractors equipment, heavy trucks & trailers, shop equipment & tools, late model cars, pickups, SUV's, vans & RV's.

TERMS AND CONDITIONS - SALE OF SURPLUS PERSONAL PROPERTY
  • 10% Buyers Premium. Cash, cashiers check, bank Master & Visa cards, wire transfers only. Personal or company checks acceptable ONLY with bank letter of guarantee.
  • The item offered for sale will be sold as is - where is, and with all faults. The Port of Tacoma makes no warranties, express or implied, written or oral, or fitness for any purpose whatsoever concerning the item sold.
  • REMOVAL: Structure must be removed from the Port premises by June 30, 2006. All costs associated with dismantling and removal of sold item shall be borne by the buyer. If not so removed, buyer will be deemed to have abandoned the item. The Port may offset its costs for reasonable storage or rental value, resale or other administrative cost from any payment made by the buyer. In the event the Port is unable to determine the precise amount of damage it will incur, the parties agree that liquidated damages in the amount of $100.00 per day shall be levied for each and every calendar day by which the removal of the building is delayed beyond the time mentioned above, as a reasonable forecast of the actual damage incurred by the Port.
  • INSURANCE REQUIREMENTS (on site work only): The successful bidder shall procure and maintain during the life of this contract, such insurance as shall protect the Port of Tacoma, the Contractor and subcontractor performing work covered by this contract from claims for damages for personal injury, including death resulting there from as well as from claims for property damage, which may arise from operations under this contract, whether such operations be by itself or by any subcontractor or by anyone directly employed by either of them.
  • Certificates of all insurance shall be filed with the Port of Tacoma and shall have named to Port of Tacoma as additional insured and shall provide (1) that the policies shall not be canceled or the amount thereof reduced, without (20) days prior written notice to the Port of Tacoma, and (2) that twenty (20) days prior written notice shall also be given if the policy is not to be renewed at the scheduled expiration date.
  • The amount of such insurance shall not be less than:
  • Bodily Injury Liability Insurance, on an occurrence basis, including contractual liability and competed operations, in an amount of not less that ONE MILLION DOLLARS ($1,000,000) for injury, including sickness, disease and death at any time resulting there from sustained by any person, and, subject to the same limit for each person, in an amount of not less that ONE MILLION DOLLARS ($1,000,000) caused by or on account of one occurrence.
  • Automobile Property Damage Insurance, including contractual liability on an occurrence basis in an amount of not less than ONE MILLION DOLLARS ($1,000,000) for damages because of injury to or destruction of property including the loss of use thereof, caused by or on account of one occurrence.
  • Miscellaneous Property Damage Insurance on broad from (other than automobile) on an occurrence basis, including care, custody and control; contractual liability; and completed operations for damages because of injury to or destruction of property including the loss of use thereof, in an amount of ONE MILLION DOLLARS ($1,000,000) caused by or on account of one occurrence.
  • All Risk Insurance: the Contractor shall effect and maintain All Risk Insurance, excluding quake and flood, naming the Port of Tacoma as additional insured upon the entire work done at any time under this contract to 100% of insurable value thereof, including items of labor and materials connected therewith whether in or adjacent to the structure insured, materials in place or to be used as part of the permanent structure.
  • The Contractor shall procure and maintain insurance in accordance with the requirements of all applicable State and Federal Workmen's Compensation Laws. Contractor shall furnish to the Port of Tacoma evidence of such insurance, including Employers Contingent liability (Stop-Gap) Insurance.
  • HOLD HARMLESS: The Port of Tacoma, it's employees and agents shall not be liable for any injury (including death) to any persons or for damage to any property sustained, as a result of or in connection with this sale generally, or in connection with the storage and/or removal of said property from Port premises, and/or the modification or performance of work on said personal property on Port premises. Buyer agrees to defend, indemnify and save the port harmless from all liability and expense (including expense of litigation) in connection with all claims, suits, and actions of every name, kind and description brought against the Port of Tacoma by any person as a result of or on account of actual alleged injuries or damages received or sustained, or alleged to have been received or sustained in connection with or as a result of the above described sale.
  • MINIMUM BID: The Port of Tacoma has established a minimum, acceptable bid of $80,000. If the highest bid submitted does not equal or exceed the minimum bid, all bids will be rejected.
